Attorney Jared Ballin of our office was interviewed by Fox25 News today, regarding an alarming number of serious injuries to customers at the new SuperCharged Entertainment go-kart, trampoline, and ninja warrior facility in Wrentham. One of the issues that comes up in cases like this is what is the effect of signing a liability waiver that the facility requires you to sign when you arrive. We understand that SuperCharged requires all of its customers to sign a liability waiver.
We have not had the benefit of picking apart this particular liability waiver but generally speaking, you are not going to a recreation facility like this and waiving your right to make a claim for personal injuries you sustain due to the facility’s gross negligence. In addition, there is a host of case law that would render some waivers not binding but they are usually enforceable, so everyone should be careful about what they sign.
Incidents like these are always case specific. For that reason, we recommend that anyone who is injured at a facility like this should consult with an attorney as soon as possible. Often, there is important evidence that is only available for a short period of time. The sooner you get in touch with an attorney, the better chance you will have to get that evidence, like security footage, photographs or witness statements to name a few.
